Research On Crime Of Abuse

Since 2012,the number of maltreatment crimes has been increasing,and the public has gradually started to pay attention to this type of crime.The thesis about the crime of maltreatment mainly focuses on the subject and behavior of it.Specifically involving the scope of the subject of the crime,the standard of crime and other judicial determination.Amendment of criminal law of the people's Republic of China(nine)adds the crime of maltreatment of the ward and guardian under article 260 of the crime of maltreatment.The definition of abuse in cohabitation or foster care is controversial.Although it is different from the traditional relationship between family members,it is consistent in nature and should be punished according to the crime of maltreatment.In terms of crime criterion,the identification of "abominable circumstances" is vague,which should be analyzed from subjective and objective aspects.In terms of behavior mode,this paper focuses on the issues related to mental abuse,including the qualitative and cognizant standards of mental abuse and whether it should be regulated by criminal law.Mental abuse is a serious form of domestic violence,which has been recognized as a criminal offense in western countries.When mental abuse leads to serious illness or suicide,the victim should be punished as such.Finally,the existing litigation mode is not conducive to the protection of vulnerable groups,and corresponding auxiliary measures should be established to enhance the practicability of the litigation mode.
