On The Criminal Law Protection Of Network Virtual Property

Nowadays,the Internet has sprung up,and cyber virtual property crimes have gradually increased.Criminal law is in an important position in regulating virtual property crimes.However,China's criminal law does not clearly stipulate the criminal attributes of virtual property on the Internet,the crime of infringing on virtual property,and how to determine the amount of virtual property.These three points are also the focal issues raised by He and Lin's infringement of virtual properties in Internet cafes.First,by analyzing the characteristics of virtual property and combining different theories of the criminal law attributes of virtual property,based on the necessity of protecting virtual property in criminal law,it is concluded that virtual property belongs to the category of protected property in criminal law.Secondly,by analyzing the crimes of damaging the computer information system,illegally acquiring the computer information system data,and crimes of violating property,the crime of virtual property is deemed to be a crime of violating property.According to this,the criminal behavior of the defendant He and Lin Characterized as theft.Finally,based on the current status of China 's virtual property amount identification,the obstacles to virtual property amount identification and the existing virtual property value identification standards in China are analyzed,and suggestions for establishing third-party value appraisal agencies and regulations for electronic data evidence are proposed to improve China's online virtual property Property amount recognition system.
