China's "Bill Law" expressly stipulates that the endorsement transfer must record the name of the endorsed person,which systematically negates the effect of blank endorsement,but blank endorsement has become a common practice in modern economic life.Due to many disputes over the relevant provisions of the Bill Law and the effectiveness of the practice of blank endorsement,there have also been a lot of disputes about blank endorsement in judicial practice.It has been 25 years since the "Bill Law" was promulgated in China,and the latest revision has also been 16 years.From the perspective of the practice of civil and commercial activities,the absolute prohibition of blank endorsement of bills has clearly lacked reasonableness in reality.This paper analyzes the cases in judicial trials,points out the focus of disputes,judges the effectiveness of current legal regulations and judicial practice in blank endorsements,explores the rationality of the circulation of such bills,and draws the conclusion that the endorsement of blank endorsements is necessary.In accordance with the legal requirements required for improvement,rationalization suggestions are made for improving legislation and related mechanisms.
