Research On The Legal Application Of Foreign-related Copyrights

With With the rapid development of global economy,foreign trade activities between countries are becoming more and more frequent,and the copyright conflicts involved in foreign trade activities are increasing and upgrading.Due to the regional characteristics of foreign copyright,and different from the property ownership in real right,the original complex application of law becomes more difficult to solve.Although the international integration of copyright protection is advancing,the copyright protection systems of different countries are different.In response to this problem,the international community and China have made relevant provisions,but there are still many problems in judicial practice,especially the application of law.Therefore,it is of great significance to study the application of law in the field of foreign copyright.This paper is divided into four parts.The first part mainly introduces the relevant theories of the application of foreign copyright law.It mainly includes the evolution of copyright,the manifestation and causes of the conflict of laws on foreign copyright.The second part describes the relevant rules of the application of foreign copyright law.It mainly includes general selection rules,international conventions and international model rules.The third part expounds the problems existing in the application of law in the ownership,contract and infringement of foreign copyright.The fourth part focuses on the improvement of the application of foreign copyright law and the relevant situation in China.The improvement opinions mainly focus on the ownership relationship,contract relationship and tort relationship.In addition,the situation of our country is mainly to elaborate the judicial status of the application of foreign copyright law in our country.The legal provisions in the legislation are not systematic,comprehensive,clear,specific and other issues,and put forward corresponding suggestions for improvement.
