Research On The Application Of The Supreme People's Procuratorate's Case Guidance System

As an important part of the case guidance system with Chinese characteristics,the supreme people's procuratorate(SPP)case guidance system plays an important role in unifying the applicable standards of laws,clarifying the vague provisions of laws,enhancing the credibility of procuratorial work,highlighting the functions of procuratorial organs and responding to social concerns.The system has been in operation for nearly a decade,and the supreme people's procuratorate has been constantly improving the design of the system in order to achieve the desired effect.The purpose of this paper is to analyze the current application status of the guidance system of procuratorial cases,point out the possible factors affecting its effectiveness and put forward the corresponding solutions,so as to cause more analysis and research on the application status and explore the way out of the application dilemma.This paper combed the prosecution case guidance system in the history of the development and progress in 10 years,combined with the concrete data,using the method of literature analysis,questionnaire survey and in-depth interviews from two aspects: express quoted,hidden guidance effect on the application of the highest inspection guide case situation carried on the thorough investigation,prosecution guiding case the current situation,the case itself coverage is relatively narrow,supply structure is imperfect,and retrieve the inconvenience for lack of binding and class in the process of case identification to distinguish supporting measures such as technical and applicable method still exists.Based on the existing problems,the procuratorial guidance cases need to be adjusted and improved in the three stages of selection,compilation and application,so as to improve the applicability of the procuratorial guidance cases and maximize the effect of the system.
