On The Legal Nature Of National Park Concessions

China's national park system pilot construction has entered a substantive stage.The "General Plan for Establishing a National Park System" states that national parks are one of the most important types of nature reserves in China and occupy a dominant position.The plan also requires national parks to implement "franchise management." This article deeply researches the legal nature of the national park franchise activities at various stages under the legal system of our country,clarifies the legal issues related to franchising,and is conducive to establishing the theoretical basis and paving the way for national park legislation research.This article theoretically divides the franchise activities of national parks into three stages according to the chronological order of related behaviors.They are: 1.the transfer of franchise rights,the legal nature of which should be recognized as a government franchise in public law;2.signing a franchise The legal nature of an operating agreement is an administrative agreement;3.The legal nature of franchise operators' franchising services is a civil legal act,and is mainly a contractual act in civil law.
