The Construction Of The Legal System Of The Right To Be Forgotten In My Country

The right to be forgotten,as a new right that comes with the Internet,can erase personal data on the internet and protect the personal interests of civil subjects,which is of great significance for the protection of personal data,information security and freedom of information.In order to protect the dignity of human beings and maintain the personal image of data subjects,it is imperative to construct the right to be forgotten in our country,based on this,the construction of the legal system of forgotten right in China is studied by means of literature research,empirical research and case analysis.Starting from the first case of the right to be forgotten,this paper puts forward the problems of the construction of the right to be forgotten in our country,clarifies the basic concept of the right to be forgotten,analyzes the legal basis of the forgotten right on the basis of the theory of legal benefit and the theory of emerging right,and discusses the practical value of the right to be forgotten,and then based on the realistic situation of the definition of the forgotten right subject,the unclear scope of the object and the unclear content of the european union,the United States and Russia.To clarify the subject,object and specific content of the right to be forgotten,design the specific legal provisions of the right to be forgotten,and establish the internal examination system,external supervision mechanism and international cooperation mechanism of the Internet enterprise,in order to construct a systematic system of the right to be forgotten.
