An Empirical Study On The Crime Of Human Trafficking In Yunnan Border

The crime of trafficking in human beings is a kind of crime that seriously infringes upon human rights,and it is also a serious global problem at present.China has always maintained a resolute attitude against the crime of trafficking in human beings,so the crime of trafficking in human beings has almost disappeared in China.However,with the imbalance of economic development and the increase of the gap between the rich and the poor in people's social life,the crime of trafficking in human beings has reappeared in recent years,showing many new characteristics.Yunnan Province has always been a province with a high incidence of human trafficking crimes,and is one of the major places of abduction in the country.In particular,Yunnan province borders on Vietnam,Laos and Myanmar,and the border area has become the main channel for transnational human trafficking crimes.This paper uses data analysis,case study,literature research and other empirical research methods to verify each other,and summarizes the causes and patterns of the illegal flow of population in Yunnan border ethnic areas,so as to get the new changes of the crime of trafficking in population in Yunnan border ethnic areas.Based on the unique historical,cultural,economic and political factors in Yunnan border ethnic areas,the problem of illegal population flow in Yunnan border ethnic areas has existed for a long time.The basis of illegal flow has led to the breeding of illegal acts,and the cross-border trafficking of human beings has also increased year by year.In the crime of trafficking in human beings in Yunnan border ethnic areas,there are two issues worthy of attention: 1.The problem of trafficking in women in the cross-border trafficking problem of "I will".By analyzing the victim's promise and the legal interest of the abduction and trafficking of women,this paper explores the particularity of the situation of "I will " in this kind of "abduction and trafficking" behavior.After research,it is found that the essence of this kind of "abduction and trafficking" behavior does not exist.Obviously,it can not be simply convicted and punished by the appearance of behavior consistent with the crime of abduction and trafficking of human beings.2.Trafficking of mentally retarded men in Yunnan border ethnic areas.After analyzing and studying the special cases,it reveals the shortcomings of the existing criminal law provisions on the crime of trafficking in human beings.The behavior of abductingand selling men can not be relied on,and the improper punishment of the crime of abducting and selling men is very obvious.According to the special problems found in the research,combined with the social patterns and cultural background of Yunnan border ethnic areas,using the comprehensive analysis of criminology,criminal policy,sociology and other disciplines,the paper gives relatively feasible countermeasures.First of all,in order to protect the rights and interests of all people,the crime of trafficking in human beings should be resumed.Secondly,we should learn from the international management of human trafficking,so as to broaden the scope of protection of the crime of trafficking in human beings.Finally,from the perspective of criminal policy,we should strengthen the policy management of the border population flow,and strengthen the efforts to protect vulnerable groups.
