Research On Administrative Regulation Of Digital Currency

Since the birth of the first digital currency in the world,the digital currency,represented by bitcoin as a typical representative,has constantly impacted the old economic order and the inherent thinking of the public.In 2019,China began to vigorously promote the development of digital economy,digital money as a high-profile field in the digital economy,its implied legal risks are also constantly highlighted,which puts forward new requirements for the administrative regulation of digital money in China.Although China denied the currency attributes of Bitcoin,banned its circulation,as early as 2013 in its Notice on Preventing the Risk of Bitcoin,and in September 2017 it issued its Notice on Preventing Tokens A notice on the issuance of financing risks called off the relevant financial institutions on digital money ICO(initial token issuance)business,but due to the early stage of the digital money laissez-faire,neglect of regulation,late severe prohibition,but no detailed,clear norms issued,this single,rigid regulation method did not solve the digital money trading,issuance,production and holder protection and other aspects of many problems.In view of the above problems,this paper focuses on the current situation of administrative regulation of digital money from the perspective of the rapid development of digital money and related technology in the digital economy,combined with typical judicial cases involving digital money The problems existing in the practice of administrative regulation,drawing on the foreign regulatory measures in the field of digital money,to analyze the difficulties of China's digital money administrative regulation,and put forward suggestions for improvement.This paper is divided into six parts: the first part introduces the background of the article,the research status of digital currency,the research significance of digital currency administrative regulation and the research methods adopted in this paper;the second part analyzes digital currency,briefly summarizes the development of digital currency,clearly defines digital currency,divides digital currency into legal digital currency and private digital currency,and analyzes its attributes and characteristics respectively;the third part defines the concept of administrative regulation,discusses the administrative regulation policies in the digital currency field of major foreign countries into four categories,and introduces three articles in the field of digital currency regulation at home Chapter four discusses the problems of digital money in the fields of trading system,specific regulation,ICO issue,production and holder protection,etc.The fifth part discusses the problems existing in digital money administrative regulation.Based on the experience of foreign regulation,this paper puts forward some suggestions to change the way of digital money regulation,make up and solve the loopholes and problems exposed,and perfect the digital money administrative regulation.
