Research On The Administrative Resolution Mechanism Of Water Disputes In My Country's River Basins

In recent years,China attaches great importance to the construction of "Yangtze River Economic Belt" and other economic development zones with river basin as the core.River basin is the link of economic development and will promote the formation of a large system of environment,economy and society related to river basin.This not only brings opportunities to the development of the areas along the river basin,but also tests the ability of river basin management in China.In practice,water disputes related to river basins occur frequently.According to relevant data,the parties to disputes are more inclined to solve the problems they face through administrative means.In terms of administrative settlement of water disputes in river basins,there are provisions in legislation,organization and settlement mode in China.However,in the practical application,the current administrative settlement mechanism of river basin water disputes in China is out of line with the actual needs.In the process of the operation of the mechanism,there are some problems,such as the lack of legislation,the unreasonable establishment of institutions,the lack of rich solutions and the low effectiveness of solutions.Therefore,through case analysis,comparative analysis and text analysis,this paper analyzes the current situation of administrative settlement mechanism of river basin water disputes in China,and through the investigation and evaluation of the United States,Japan,Germany and other countries with mature experience in this field,combined with the reality of China,puts forward suggestions for improving the administrative settlement mechanism of river basin water disputes in China.This paper is divided into four chapters.The first chapter elaborates the related concepts of administrative settlement of river basin water disputes in China.In the second chapter,through the analysis of the two cases,the author brings out the thinking of the administrative settlement mechanism of water disputes in the river basin of our country,and analyzes the current situation and shortcomings of the administrative settlement mechanism of water disputes in the river basin of our country.In this chapter,the author shows the current situation of the administrative settlement mechanism of water disputes in river basins from three aspects: legal provisions,institutional settings and settlement methods.Based on this,the author points out that the mechanism is faced with four deficiencies: imperfect legal provisions,unreasonable institutional settings,inflexible settlement methods and low efficiency of treatment results.In the third chapter,the author analyzes the administrative settlement mechanism of river basin water disputes in the United States,Japan and Germany,summarizes the mature experience of the three,and puts forward some ideas for China to improve the corresponding mechanism.In the fourth chapter,the author puts forward some suggestions to improve the administrative settlement mechanism of river basin water disputes in China.In this chapter,the author analyzes the shortcomings of this mechanism in China and the mature experience of other countries,and puts forward the specific path to improve the administrative settlement mechanism of river basin water disputes in China from the four aspects of legislation,institutional setting,settlement methods and the effectiveness of dispute settlement results.
