Research On Civil Legal Relationship In Live Streaming

With the continuous development of Internet technology,the live broadcast industry presents blowout development in 2016,the rapid development of live delivery economy,and the increasingly prominent role of promoting the economic development of our country,which has become a new economic phenomenon in modern society.Live delivery is based on the Internet live broadcast technology,in a webcast platform to explain,display goods and real-time interactive commodity sales activities.The webcast has reduced the purchase cost of consumers and increased the sense of participation of consumers,especially during the outbreak of new crown pneumonia,which has played an irreplaceable role in the recovery of our economy.Live delivery is "Internet ".The rapid development of live delivery industry has also brought a lot of problems,such as the continuous occurrence of live rollover incidents,live sale of fake,false publicity,data fraud,network infringement and other dishonest acts,these acts continue to infringe on the legitimate rights and interests of consumers,but also have a negative impact on the sustainable development of live delivery industry.The main reasons for the chaos of live broadcast with goods are that the legislation of our country is not perfect,the government supervision is not in place,the industry autonomy is not sufficient,the enterprise is too much in pursuit of the interests of social responsibility is missing,the consumer rights protection is not active,and the cost of safeguarding rights is high.In this paper,the author points out that there are many legal subjects involved in live delivery,including anchorman,live delivery platform,merchants,consumers and so on.On the basis of analyzing the related legal relations,this paper puts forward that we should make clear the nature of live delivery,determine the legal status of anchor,and put forward some suggestions to perfect laws and regulations,strengthen external supervision,perfect industry standards,and increase industry autonomy to regulate the chaos of live delivery.
