Victims Commit To Difficult Problem Research

With the development of society and the continuous improvement of criminal law theory,the victim commitment has attracted the attention of domestic and foreign scholars because of its unique status and role,and the individual's right to make decisions has been respected to a greater extent.In the judicial practice of our country,the actual problems of victim's commitment are increasing,and the existing problems are also more complicated.Through the study of the constituent elements of the victim's commitment,the subject of the promise and the conditions of the promise are clarified to prevent abuse of rights.Under different circumstances,the victim's commitment has produced different legal effects,which need to be analyzed in conjunction with the specific crime.The atypical victim commitment research completes the theoretical framework of victim commitment.Analyzing the different problems caused by the victim commitment under specific crimes provides different solutions to complex practical problems.This article analyzes the judicial case of the victim commitment,summarizes the related issues of the victim commitment,and combines my own point of view to improve the framework of the victim commitment to provide more ideas for the improvement of my country's criminal law theory.Try to proceed from Chinese practice and combine existing theories and practices to contribute meager efforts to the application and improvement of criminal law.
