| Since the 19 th National Congress of the Communist Party of China,under the leadership of the Communist Party of China,China has strengthened its anti-corruption efforts through various ways and means,and the special rectification work of overseas recovery of stolen goods has achieved remarkable results.The "Skynet action" organized by the Supervisory Commission and the "100 Hongtong personnel" pursuit and escape actions led by the Party Central Committee have effectively reduced the loss of state-owned assets.However,due to the lack of experience in overseas stolen goods recovery and the weak legal basis compared with other countries,there are still many problems in the implementation stage.To further promote the modernization of the national legislation on overseas recovery of stolen goods is not only the only way for the development of overseas recovery of stolen goods in our country at the present stage,but also has an enlightening and guiding role in exploring the ways of recovery of stolen goods.This paper is divided into three parts.The first part gives an overall overview of overseas recovery of stolen goods,including its concept,main methods and relevant legal basis;the second part puts forward the current difficulties faced by China's overseas recovery of stolen goods through the analysis of cases,respectively from the aspects of domestic obstacles,foreign obstacles and the disposal of asset recovery;the third part discusses China's overseas recovery of stolen goods This paper puts forward relevant suggestions for the improvement of the system,and puts forward corresponding solutions for the problems mentioned in the second part.Through the analysis of the existing successful cases of recovering stolen goods in China,this paper sums up the experience and puts forward some suggestions for the overseas recovery procedures and legislative needs of our country,in order to make some modest contributions to improve the overseas recovery mechanism of our country. |
