Analysis Of Online Literature Copyright Protection

Affected by this cultural prosperity,there have been endless online literature copyright infringements,such as the well-known problems of pirated websites and plagiarism.Internet literature infringement cases have risen up in double among the aspect of judicial practice.The country's current copyright law has also been affected,which not only promotes its update and reform,but also faces great challenges.In May of this year,the word "reading" suddenly appeared on the homepages of major news media,attracting a lot of attention.It also makes the author start to pay attention to the creator groups.In order to the promote the development of the online literature industry and the protection of intellectual property rights of authors.This article is divided into four parts to try to analyze the protection of online literature in my country by understanding and thinkingThe first part demonstrates several typical online literature copyright infringement cases,and analyzes the judgment methods and standards used by judges in affirming of online literature copyright infringements,as well as the encountered problems and difficulties such as the inconsistent standard of damage compensation or the difficulty to obtain evidence in judicial practice.Focused on combining theory with practice,this thesis deeply analyzes the existed problems in the copyright infringement of online literature.The second part compares traditional literary infringements and analyzes the existed types and characteristics of behaviors that infringe on the copyright of online literature.The main types of behavior include copying and publishing,plagiarism,and adaptation and modification.In the third part,through a large amount of data collection,the case summarizes the problems in the field of infringement of online literature cases in the process of judicial practice in my country,and tries to give opinions.The fourth part lists the methods currently used by our courts in judging whether online literature infringes copyright.Hope it will be helpful to the future network literature copyright protection.
