Research On The Dispute Settlement Mechanism Between The Host Country And Foreign Investors

With the rapid development of global economy,and the rapid development of international investment,international investment disputes are also increasing,among which the disputes between the host country and foreign investors are increasingly prominent.The existing dispute settlement mechanism has shortcomings in adjusting the investment disputes between the host country and foreign investors.This paper selects ICSID dispute settlement mechanism,WTO dispute settlement mechanism,usmca dispute settlement mechanism,CAFTA dispute settlement mechanism and bilateral dispute settlement mechanism which are representative in multilateral dispute settlement mechanism as the research focus.Through a brief introduction of various dispute settlement mechanisms,this paper analyzes them in detail Finally,from the perspective of balancing the interests of the host country and foreign investors,this paper puts forward some suggestions to improve the existing mechanisms.Through the improvement of the existing dispute settlement mechanism,to make up for its shortcomings,so that the investment disputes between the host country and foreign investors can be effectively resolved,in order to achieve the balance of the protection of interests between the host country and foreign investors,so as to achieve mutual benefit and win-win.
