The emergence of digital currency is the result of technological innovation and market demand.From the perspective of the evolution of money carriers,human beings have experienced multiple stages such as commodity currency,precious metal currency and credit currency,and are now in the transition stage from electronic currency to digital currency.Currency security is the lifeblood of national economy,and the legalization of digital currency is an inevitable trend.Many countries in the world are carrying out the practice of legalization of digital currency,while China firmly holds the initiative in the field of research and development of legal digital currency,and the pilot test results are good.Legal digital currency can bring many potential benefits,such as faster transaction efficiency,more reliable security mechanism,more economical transaction costs,guarantee of national monetary sovereignty,promote the internationalization of the RMB,etc.However,there is no denying that the early digital currencies represented by Bitcoin have caused many legal and regulatory difficulties.Due to the rapid development of science and technology and the relative lag of national currency-related laws,illegal behaviors,including cross-border money laundering,counterfeiting crime,endangering data security and other problems have become increasingly apparent,which have caused a serious impact on financial supervision work.In the case of legal digital currency,the original paper or metal carrier will no longer exist,and some original laws and regulations supporting it will not be effectively applied.Therefore,in addition to the technical considerations,it must be guaranteed from the legal system level,so as to establish a sound legal digital currency supervision system.To be specific: First,establish a perfect legal digital currency anti-money laundering system;Second,improve the user personal information protection mechanism and related data protection mechanism;Third,establish a perfect mechanism to prevent legal digital currency counterfeiting;Fourthly,the legal status of legal digital currency should be clarified;Fifth,we will improve the regulatory system and innovate the application of regulatory technology.
