A Study On The Distinctiveness Of Sound Marks

With the rapid development of commodity economy,trademark is paid more and more attention by operators.Having its own trademark is the trend of the times under the situation of rapid development of global economy.In particular,the sound trademark was listed as one of the constituent elements of the trademark in the Trademark Law amended in 2013.But the sound trademark starts late,the development is not perfect,and there are many problems exposed in practice,especially the significance examination of sound trademark.Because there is no uniform and significant examination standard in our country,the evaluation results of judicial and administrative organs may be different in practice,which brings difficulties to the registration of sound trademarks of enterprises.Based on the basic theory and analysis of the legal cases of Tencent and Millets applying for registration of sound trademark,this paper summarizes the problems in the examination of sound trademark significance in China,such as the lack of uniform standard,unclear status of obtaining significant examination,etc.In order to solve the sound trademark in the significance of the problem.
