| At present,there have been a large number of disputes based on the right to the use of homestead,which has become an important factor affecting the stability of rural society.At the same time,it is also the problem that rural management must face.From the perspective of the practical advancement of rural revitalization strategy,the stability of farmers homestead is also closely related to whether farmers can concentrate their energy and time on rural revitalization strategy.Therefore,both the modernization of rural governance and the modernization of rural governance capacity and the implementation of rural construction actions need to effectively resolve various conflicts and contradictions in rural areas,so as to lay a good and stable social foundation for the implementation of rural revitalization strategy.As for the research on rural homestead disputes,according to the information mastered by the author,there are few research results on homestead disputes as the theme,and more media news reports focus on the discussion of homestead disputes.In addition,many research results have included this issue in the study of rural land policy,which is generally included in the study of policy changes of rural homestead,rural homestead transfer and the legal system of rural homestead.However,the research on rural homestead disputes is not concentrated or in-depth.At present,homestead disputes are constantly emerging in the policy of "separation of three rights" and new policies,and there are many new measures to continuously promote the circulation and replacement of homestead.In the process of promoting the rural revitalization strategy,the construction of livable countryside should be carried out continuously,which directly points to the problem of how to use rural homestead in a better,more effective and more intensive way.This involves not only the effective use of individuals,but also the effective use of homestead resources for the whole village collective.In some places,because of the overall layout of the village planning,the homestead disputes have emerged many new situations.This article mainly by the way of case study,the current types of rural homestead disputes were summarized and the core.This research thinks,from the perspective of the subject,there are four main types of land disputes: family members within the property inheritance between farmers and autonomous organization type,type and farmers before intervention in rural enterprises for the transfer of the right to the use of conflict of interest,the conflict between farmers and local planning,at the heart of the dispute is dependent on the right to use house sites of huge economic benefits.There are three main ways to solve homestead disputes: autonomous consultation,administrative adjudication and judicial approach.In general,petitioning rights protection is the result of the accumulation of contradictions caused by the failure to solve the homestead disputes effectively.This paper does not regard it as a separate way of governance.In the overall investigated after different types of disputes and its governance,this paper concludes that the current problems of governance,mainly including governance system and management ability,autonomous organization authority and huge economic interests conflict,administrative and judicial ruling way evidence difficult way the high cost problem,put forward the "three fusion cure" as the core,and build different management strategies according to different types of disputes,and constantly optimize the existing governance,construct the modern management system and shaping different governance body modern governance countermeasures and Suggestions. |
