After 40 years of reform and opening up,my country's market economy has developed prosperously,financial laws and regulations have been continuously improved,and judicial interpretations have been refined.However,the crime of illegally absorbing public deposits has always been a typical crime.The legislative flaws and judicial application of this crime are hot topics in academic circles.At present,most scholars have reached a consensus on the interpretation of this crime,but how to apply the crime of illegally absorbing public deposits has not yet formed a unified understanding.In the legislation,this crime has the problems of generalized application of blank crimes,blurred boundaries with private lending,and low prosecution standards.It faces difficult problems such as crime and non-criminal,unit crime and joint crime,and determination of the amount of crime in the judiciary.Investigate its fundamentals The reason lies in the absence of civil and administrative front-end legal norms,and judicial practice is forced to expand its application due to the needs of social stability.Restrictive application is not a one-size-fits-all rule of absorbing public funds that are not used for capital operations.Absorbing public funds for their own production and operations without effective supervision may also have serious social harm.The crime of illegally absorbing public deposits is the most common crime for maintaining the country ' s financial management order.Only by improving front-end laws and regulations to narrow the boundaries of crimes,using substantive interpretation methods to appropriately limit them,clarifying the connotation,and positioning accurately,can the last line of defense be effectively used.
