Research On Advance Compensation System For Investor Protection Institutions

The amendment of the Securities Law established the system of advance compensation at the legal level for the first time,it not only provides diversified channels and ways for investors to solve securities illegal disputes,it also means that China's investor protection in the capital market has risen to a new level.However,the provisions of the current system are relatively principled,and there are few practical cases,especially in the insurance agency led by the internal relationship and the implementation of the key points need to be further clarified.Therefore,on the basis of clarifying the origin and internal legal relations of the first compensation system,following the provisions of the law,from the perspectives of the subject of investment,the object of compensation,the basis of operation and the subsequent recovery,explore the problems that are likely to occur in the application of the system,analyze the causes of disputes and put forward reasonable suggestions,in order to hope that in the event of fraud in the securities market in the future,the legitimate rights and interests of both investors and capital contributors can be taken into account,fundamentally promote the establishment of long-term mechanism of the system.
