Research On Family Mediation System

In the current process of deepening the country's reforms,the reform of family trials is also constantly being pushed forward.Scholars in the legal sciences and judicial professionals are paying more and more attention to the use of mediation to resolve family disputes,and professional mediation of family disputes The demand for family mediation is also growing.However,for family mediation,both the substantive law and the procedural law are lacking in our country's legal norms,which makes the development of the family mediation system heavy and slow.Therefore,this article starts with the basic content such as the conceptual features and scope of the family mediation system,intersperses with the development experience of foreign countries and regions,and deeply explores the innovative measures of the family mediation system in various pilot courts in our country.On this basis,it finds and proposes current national affairs.Some problems in the mediation system,and proposed solutions.This article mainly consists of four parts.The first part is to sort out the relevant knowledge of the family system to explain its basic connotation.The focus of this part is to define the scope of the current family mediation.The second part analyzes and introduces various reform measures related to the family mediation system of the pilot courts set up in our country,and lays the foundation for the third part of the question on the basis of referring to the development results of foreign countries.The third part mainly discusses some problems in the development of the current practice of the family mediation system in my country based on the analysis of the practice of the above pilot courts,mainly from the three aspects of legislation,the connection of mediation and the selection of mediators.The fourth part is the important content of this article,which is to make some suggestions for the development of our country's mediation system through the problems found in the previous article,in order to improve the current development of our country's mediation system.
