On The Effective Defense In Plea Guilty Plea Cases

Establishment and implementation of the system of leniency for guilty plea,it has greatly enhanced the efficiency of criminal proceedings in China.However,while improving the efficiency of litigation,we should also pay attention to protecting the rights and interests of the accused and achieving effective defense.On the basis of studying existing effective defense concept,through to the confession greater forfeit system effective defense lawyers theoretical research and judicial application,pleaded guilty to forfeit their case there is no clear regulation effectively defend the standard,the different stages of litigation lawyers working paper analyzes,on duty lawyer system is not perfect and the lack of effective disciplinary punishment mechanism is analyzed,On this basis,from a clear confession of punishment in the case of effective defense standards,establishing the connection mechanism of lawyers' work in different litigation stages,perfecting the system of on-duty lawyers and establishing effective punishment mechanism for lawyers.we can draw useful experience from the plea bargaining system in the United States and the German criminal consultation system,this paper puts forward some suggestions to realize the lawyer's effective defense in the case of guilty plea.
