Legal Research On The Market Access System Of Asset Management Business

The chaos of asset management industry has become a hot issue in legal theory and practice.This paper holds that perfecting market access system is the key to control the chaos of asset management industry.In this paper,the following parts will be discussed: the first part,first of all,from the theoretical discussion of asset management products concept,legal relations and basic law.The second part introduces the present situation of the market access system of asset management business in China.The market access system of asset management business mainly includes two methods:market main body access and market business access.This paper compares the conditions of market main body access and market business access procedures in the form of tables,which makes the relevant legal norms of the two methods more direct and discusses the problems of market access system in China.The third part discusses the necessity of perfecting the market access system of capital management business.Firstly,through the analysis of the contradiction between financial innovation and financial market access system,the author refutes the viewpoint of questioning the necessity of financial market access system.Secondly,the necessity of financial market access system is systematically analyzed by revealing the causes of the subprime mortgage crisis in the United States.The fourth part introduces the market access system of asset management business.Firstly,the concept of market access system is introduced;secondly,the value system of financial market access system is introduced,and then the supervision method of market access system of asset management business is introduced.Finally,the regulatory agency of market access of asset management business is introduced.The fifth part puts forward the feasible suggestion to perfect the market access system of China’s asset management business.This paper proposes to perfect the market access system in the financial commodity trading law through the formulation of the financial commodity trading law.Not only that,this part puts forward the feasible opinion to the asset management product access system,through the establishment of the capital management product nonconformity standard,the capital management product transparency standard,the asset management product early warning mechanism method refines the asset management product access standard,and strengthens the dynamic law enforcement supervision.Hope that through the study of this paper,can improve the asset management industry regulatory system to provide help.
