Investigation And Research On The Reform Of Civil Case Filing And Registration System In Y District People's Court In C City

In order to solve the problem of "difficulty in filing a case" in judicial practice,China has changed the case-filing examination into the case-filing registration,which marks a step forward in the process of judicial reform to protect the right of action.The implementation effect of the case registration system is obvious,but the accompanying problems can not be ignored:The theoretical and practical circles have different understandings of the "registration system".The theoretical research expresses its own opinions while the practical operation chooses its own way.The prominent contradiction between persons and cases restricts the strict implementation of the registration system.The phenomenon of false and repeated litigation is rampant,and the filing registration system becomes the vent of the dissatisfied.Filing to take the number is difficult,the hall of filing a long queue,etc.The above issues are all commonplace since the implementation of the case registration system,domestic scholars have done a full discussion and research on it,so the author will not do too much redundant.In this paper,based on the author's own investigation data and material research in the People's Court of Y District in Chongqing,the author analyzes the actual problems that are difficult to be noticed by the outside world,so as to put forward countermeasures and suggestions.This article consists of six parts in total.The introduction part includes the reason,significance of topic selection and domestic research status.The first chapter mainly introduces the research object and research method.The second chapter is mainly about the data collected by the author during the internship,questionnaire survey and sample analysis.The third chapter mainly summarizes the problems in the reform of the case registration system of Chongqing Y District People's Court,which mainly includes that loopholes in the operation process of case filing,repeated trial of prosecution conditions,closed examination and approval procedures and internal supervision,digital bottleneck of online case filing,etc.The fourth chapter puts forward some suggestions on the case registration process.The conclusion part mainly reviews the problem analysis of the whole article and the corresponding solutions.In short,based on the survey data,this paper summarizes the problems from different perspectives,in order to solve the reform of the case registration system of Y District Court.At the same time,providing reference for other courts which can make the reform of the case registration system play a greater judicial effect and value in the practice of Chinese courts.
