Research On The Disposal System Of Fined And Confiscated Items In Wildlife Protection Administrative Law Enforcement

The management of confiscated goods in the administrative law enforcement of wildlife protection is a prominent problem that has puzzled the administrative law enforcement agencies for a long time.Due to the lack of specific management system in law enforcement follow-up,and the phenomenon of "heavy penalty but not heavy management" in law enforcement practice,a large number of confiscated items of wild animals and plants have to be simply shelved in law enforcement practice.There is not only a lack of professional storage warehouses for storage,but also a lack of classified management of confiscated items of wild animals and plants,which greatly increases the risk of losing the value attribute of confiscated items of wild animals and plants in administrative law enforcement.With the accelerating process of China's ecological civilization construction and the deepening of the reform of the nature protection system,the number of administrative illegal cases of wildlife protection and the number of items seized have increased rapidly year by year.The Measures for the Administration of Confiscated Property,which was formulated by the Ministry of Finance and implemented on January 1,2021,provides for the management and management system of confiscated property,but there is still no specific management method for confiscated property in the administrative law enforcement of wildlife protection.By summarizing the sources and implementing agencies of confiscated items in wildlife protection administrative law enforcement,the types and characteristics of confiscated items in wildlife protection administrative law enforcement were summarized,and the main regulations on the management of confiscated items in wildlife protection administrative law enforcement were combed.It can be discussed that the causes of the problems in the management of confiscated goods in the administrative law enforcement of wildlife protection include legislative level,objective management difficulties,the absence of unified management and management institutions,and the lack of specific management procedures.On the basis of the above research,it can be concluded that the principles of management and management should be clarified,the management system should be refined,the management procedures should be standardized,the classified management system of confiscated goods should be implemented,special foundations should be set up for management on a trial basis,the government public property warehouse system should be improved,and the management supervision system should be improved.
