With the rapid development of information networks,people's lifestyles and expressions have been changed,and a new channel for people's information transmission has been provided.The application of face changing technology,although for our film and television industry to save production manpower,for people's entertainment life has brought a qualitative change.However,the widespread use of face-swapping technology has been accompanied by an increasing number of infringement incidents.Although face swapping technology has not been widely known in China for a long time,the potential risks brought by face swapping technology have been highlighted,and the law should have a forward-looking prediction and appropriate coping mechanism for this problem.The use of face-changing technology has led to endless problems of copyright infringement.In terms of right determination,whether the short face-changing videos produced by using this technology are works under the copyright law,whether they meet the requirements of originalitythe difference in the criteria for determining originality,and whether the short face-changing videos are protected by the "Copyright Law".Works,which in turn affects the determination of the rights of the relevant right holders.There is also the determination of whether the replacement of half of the face or part of the facial features infringes the performer's rights of the performer,Can the face-changing short video find a matching position for it in the Copyright Law,and what is its legal status and degree of protection?Secondly,the performers have the right to protect the performance image from "distortion",and can they regulate the unauthorized substitution of performers' facial features in film and television works by related actors.What kind of understanding and interpretation should be done to protect the performance image from "distortion".This article proposes:First of all,whether the short video using face-changing technology is original or not should be analyzed based on the two parts of "independence" and "creation" as the standard.Secondly,when using face-awapping technology to replace performers' facial features and lead to distortions of the perfoemance image,the key is how their subjective intentions are.Third,the use of face-changing thchnology to distort the image of the performer has an adverse impact on the righht to modify the copyright owner and the right to protect the integrity of the work.Finally,whether the replacement of the performer's image in the face-channging video infringes the performer's image in the face-changing video infringes the performer's related rights.In terms of liability,anyone who violates the law and commits acts that infringe on the rights and interests of others shall bear the corresponding infringement liability.The infringement of face-changing technology usually involves multiple objects protected by the Copyright Law,as well as multiple actors.Judging from the results of the infringement of the face-swap technology,there is a phenomenon of multiple causes in one country..Internet users who use face-changing technology to infringe the rights of others' copyrights shall be held accountable.It is more reasonable to apply the no-fault principle to solve the problem.
