Research On Copyright Protection Of TV Program Mode

In recent years,the TV program model industry has developed rapidly,and TV programs have entered an unprecedented period of development opportunities and prosperity.At the same time,Chinese TV programs are showing an increasingly severe trend of homogeneity and entertainment,and there are overall low quality and infringement disputes.Frequent occurrence of serious problems,which pose a huge obstacle to the development of the country,nation,and regional culture.In this context,building a new ecological system of China's TV program model is not only an inherent requirement for the healthy development of Chinese TV programs,but also a due meaning of my country's comprehensive promotion of cultural self-confidence in the new era.Based on a panoramic scan of the ecological status quo of China's TV program model,this paper combines the specific work needs of promoting national culture in the new era and the overall environment of media integration to form a research result on the copyright protection strategy of China's TV program model.This achievement mainly includes four aspects:The first part is to review the definition of TV program mode in the scientific community and demonstrate the feasibility of copyright from the perspective of TV program mode conforming to the nature of the work,and then from the legislative intent of the copyright law to encourage innovation,The actual needs of the national copyright strategy,the need to solve the serious problems of homogeneity and plagiarism,meet the diversified needs of audiences,and implement the strategy of cultural power to further demonstrate the necessity of TV program models protected by copyright law.The second part is to sort out the current dilemma that my country faces in copyright protection of the TV program model.First,the TV program model is not included in the protection object of the copyright law.The second is that the TV program model is restricted by the dichotomy of thought and expression.The third is The standard of originality of TV program model is uncertain.Fourth,it is difficult to identify infringements of TV program model.Fifth,the standard of compensation for program model infringement is uncertain.In order to help the reform and development of my country ' s TV program model industry,it is necessary to examine the beneficial experience of the copyright protection of TV program models in foreign countries or institutions.The purpose is to critically absorb and reform its experience for use in the construction of the rule of law in our country.This constitutes the first part of this article.three parts.The fourth part is based on the real dilemma faced by the TV program model,and draws on the useful experience from outside the territory,and puts forward targeted suggestions for the improvement of the protection of the TV program model of the copyright system in our country.The first is to expand the extension of the work and include the program model into the copyright.The scope of the object of legal protection is to determine the originality standard of the TV program model,the third is to determine the method of determining the infringement of the TV program model,the fourth is to refine the standard of compensation for the infringement of the TV program model,and the fifth is to play the role of the self-regulatory organization of the program model industry.
