| The revision of the Land Administration Law in 2019 to remove legal obstacles to the entry of collectively operated construction land.However,the law is relatively simple.There are some problems in the distribution of value-added benefits.First,there is controversy among the main body involved in the distribution of value-added income,and there are different opinions between local governments and some collective members on the distribution of participatory income in practice.Second,there is a dispute over the proportion of value-added income distribution.Because of the imbalance between the power of the government,the collective and the individual,there is bound to be insecure interests of vulnerable groups in the proportion of income distribution.Therefore,it is necessary to compare the reasons for the problem and find a solution.The reasons for these problems include the existence of game competition among various interest subjects,the mismatch between the government's participation in the allocation of value-added income and its own functions,the imperfect democratic mechanism at the grassroots level,and the insufficient standardization of the decision-making process of value-added income distribution.It is suggested that in terms of the main body of income distribution,the law clearly specifies the main body of income distribution in the market,and clearly specifies the definition criteria of membership rights.In terms of the proportion of income distribution,it is clearly stipulated that the government participates in the distribution of income in the form of taxation,and the legislature will prescribe taxes and tax rates.In order to protect the rights and interests of collective members,the state intervenes appropriately,and clarifies the proportion and use of farmers' collectives,so that collective members can fully exercise their right to autonomy within the limits prescribed by law. |
