Notaries Participate In The Research On Judicial Assistance Affairs

This paper intends to study the mechanism of notarization participating in judicial auxiliary affairs suitable for China's national conditions and provide theoretical support for practice.To explore the functions of the notary how to maximize in diversified dispute settlement mechanism,through the appeal related dispute mediation before litigation,service and so on transactions and simplified shunt,help the financial burden on the court at the same time,to find self-worth and positioning,notary organ to clear the future development direction,finally realize the win-win purpose.The first part is the theoretical basis of notarization's participation in judicial auxiliary affairs,which defines the scope of notarization's participation in judicial auxiliary affairs,and introduces the origin,necessity and feasibility of notarization's participation in judicial auxiliary affairs,thus laying a theoretical foundation for notarization's participation in judicial auxiliary affairs.The second part introduces the notarization to participate in the judicial practice status of auxiliary affairs,in 2017,the implementation of notarization in the people's court judicial notice of the pilot assisted transaction on participants range specified in item by item analysis notarization to participate in judicial mediation,auxiliary affairs service,evidence collection,preservation,implement the practice of the status quo,in order to more intuitive,which included some data to show.The third part is about the difficulties and difficulties in the notarization's participation in the judicial auxiliary affairs.From the legal perspective,the specific problems encountered in the notarization's participation in the judicial auxiliary affairs are excavated,and the explanations are made to discuss the difficulties.The fourth part is the experience from outside the region.The notary system of Latin notarization countries can provide inspiration for the construction of China's notary participating in the judicial auxiliary affairs mechanism,and the new development of its notary function extending to the judicial auxiliary field should be used for reference by us.The fifth part is the basic conception of perfecting the notarization judicial auxiliary affairs.In view of the above mentioned problems,the system of notarization participating in judicial auxiliary affairs is constructed from the macro and micro levels.
