User created content(UGC)is a user who is not profit-making and does not have professional characteristics through the open Internet platform.It publishes creative content through the Internet,and creates and uploads works into the Internet through original,compilation,adaptation,conversion,deletion and increase,including a large number of works submitted according to the secondary creation of existing works The work that is now out.In the digital age,the reproduction and dissemination of works are accelerated.The creation of works by users using others is not in the circumstances stipulated by the reasonable use system,nor authorized by the copyright owner.Such use behavior is often suspected of infringement.Under the current copyright system,the copyright licensing system,reasonable use system and the rules of the haven are difficult to solve the problem of infringing copyright by the user's creation content.The content created by users has the characteristics of encouraging cultural product innovation and guaranteeing freedom of expression,and promoting the development of democracy and multicultural society.However,under the circumstances of user creating and disseminating UGC works,the copyright dilemma faced by users in creating content cannot be solved by copyright licensing system.Therefore,this paper demonstrates the dilemma of copyright faced by users: imbalance of copyright interest relationship caused by user created content,copyright license dilemma of user created content,and reasonable use in regulating users The limitation of creation content and the limitation of the rules of the haven in regulating the content of user creation;then,the reasons for the above difficulties are analyzed.Combined with the methods proposed in the protection of the user creation content both inside and outside,the principle of interest balance should be followed,the reasonable use system should be reshaped,the licensing system and technical measures should be improved so as to balance the interests between the copyright owner and the public,and make the copyright law law more balanced Develop in coordination with culture and science and technology.
