A Comparative Study Of The Testamentary Succession System Between China And Russia

The testamentary succession system in China and Russia has experienced a long historical evolution.The implementation of the Civil Code of the People's Republic of China coincides with the revision of the succession edition of the Civil Code of the Russian Federation,which provides an opportunity for a comparative study of the testamentary succession systems between the two countries.The latest concept of my country's testamentary succession system can provide a new direction for the revision of Russia's testamentary succession system.The practice of the Russian testamentary succession system can provide a reference paradigm for the application and interpretation of the testamentary succession system in my country.By exploring the historical evolution of the testamentary succession system in China and Russia,this paper analyzes the differences and characteristics of the two countries' testamentary succession systems.This paper selects the form of will,freedom of will and its limitations,interpretation of will,and execution of will to objectively analyze the advantages and disadvantages of the two countries' testamentary inheritance systems.The advantages of testamentary inheritance in Russia have important reference significance for my country to improve the system of freedom of wills,interpretation of wills,and executors of wills.The advantages of my country's testamentary succession system can provide a reasonable reference strategy for Russia to improve the form of wills,reduce the standard of mandatory inheritance,and strengthen the supervision of wills execution.
