A Study On The Standardization Of Administrative Inspection Procedures

Administrative investigation is an independent administrative law enforcement link for administrative organs to understand the compliance of administrative counterparts,and plays an important role in monitoring the implementation of laws and discovering illegal acts.In order to meet the needs of comprehensive economic and social development in the new era,it is necessary not only to curb improper investigations that interfere with the public and enterprises,but also to deepen the construction of a service-oriented government.Driven by the strengthening of interim and ex-post supervision and the policy of double random and one disclosure,administrative investigations urgently need to be further specification.As an important tool for realizing substantive justice,procedures can promote the formation of rational investigation conclusions,regulate the implementation of investigation behaviors through the procedures themselves,clarify the starting conditions of investigation procedures to limit the arbitrariness of investigation agencies,and clarify the main links of investigation procedures to prevent investigation agencies from arbitrarily enforcing the law.The common problems reflected in the practice of administrative law enforcement urgently need to be responded to at the legislative level,that is,legal regulation of problems such as the abuse of power by the investigation organs during the investigation process,the unclear rights and obligations of administrative counterparts,and the lack of internal administrative supervision.In addition,digital government construction has brought challenges and room for technological development to administrative law enforcement activities including administrative investigation.The application of off-site investigation methods has already had an impact on traditional administrative procedures,and the combination of big data technology and administrative procedures will be more closely.
