Research On The Difficult Problem Of Bribery Crime

As one of the most serious duty crimes,bribery has always been severely attacked.Today,Bribery crime "advances with the times" as China's economy develops rapidly.,and not only the number of crimes of accepting bribes increases year by year,but also the means of accepting bribes are increasing,which makes the investigation and punishment of the crime of accepting bribes more and more difficult.Despite the fact that academics have continued to research the crime of passive bribery,there are still many challenges in judicial practice regarding the subject matter and behavior of passive bribery.In 2018,the implementation of the People's Republic of China's supervision law sparked a heated debate in the theoretical and practical circles of criminal law about the topic scope of bribery.Prior to the introduction of the Criminal Law Amendment(IX),there was a lot of confusion about the creation of the offense of accepting gifts.Although the act of taking gifts was not included in the amendment,it will undoubtedly be included in the purview of criminal law in the future.The determination of attempted bribery has always been a difficult problem for judicial application,it is particularly difficult to determine new sorts of bribery that have evolved in recent years.This paper discusses the subject of bribery,the act of accepting gifts,and the cessation form of bribery through three controversial cases in practice and the relevant doctrines in the theoretical field,and recommends expanding the definition of bribery to include the offence of "accepting gifts."...
