Research On The Application Of Personal Information Protection Notification And Consent Rules In My Country

The advent of big data era brings new challenges to personal information protection.Both the Civil Code and the Personal Information Protection Law clarify the status of the notification of consent rule in the protection of personal information,and the latter also provides more detailed provisions on the notification of consent rule,but there are still many problems in the process of specific application.This paper is divided into three parts: first,it explains the meaning and essence of the rule of informing consent of personal information,so as to clarify the status of the rule of informing consent in the protection of personal information.Secondly,through the analysis of typical cases in practice,the problems in the application of the consent notification rule are pointed out.Finally,by analyzing and learning from the legislative experience of foreign countries,we propose suggestions to improve the application of the rules of informing consent for personal information protection in China,taking into account the current situation in China.
