Research On The Crime Of Infringing Citizens' Personal Information

With the continuous development of the Internet era,citizens' personal information has also become an important resource in daily life and business transactions.At the same time,risks also follow.In recent years,China's violations of citizens' personal information are increasing,and the harm to the society is also gradually deepening.China's legislation regulates the evolving criminal acts of infringing on citizens' personal information by issuing amendments to the criminal law and judicial interpretation,but there are still many problems in the conviction and sentencing of this crime.Through the summary of the basic facts,according to the basic disputable point and the results of the crime in the judicial practice of the recent three years,the author summarizes the basic case,so as to analysis the problems of this crime in the recent years in China.By analysing these problems,it is concluded that there are some problems in the crime of infringing on citizens' personal information,such as the definition and sentence of the crimes,the determination of the status of each perpetrator in the joint crime,the determination of the number of crime forms of some crimes by means or purpose of infringing upon personal information,and the application of mitigated punishment.With the improvement of the front-end law,there are differences between the criminal law and the front-end law,and there are also deficiencies in itself.Appropriate adjustments should be made based on the current legislation and judicial trial practice,so as to better ensure the unity of trial and improve the efficiency of judicial trial.
