Retirement should be a right,Those who have reached the legal retirement age,Should be a right to choose,not be restricted by age,in the over-age people choose to re-employment,forced out of the working state over-age people.Moreover,We can't exclude overage workers just because of our differences between the over-age and the ordinary labourer and protect the legitimate rights and interests of the over-age workers,especially Especially when an overage worker has an injury at work,the right of the over-age workers to post-injury relief.There are still many areas where the legal protection of over age workers has not been done well.such as laws and local legislation are not matched and the remarkable local characteristics of local regulations at various levels,in the same case,the higher and lower courts decided differently.Causing injury at work,The injured worker applies department,and the Regulations on industrial injury insurance can not be applied because the over-age of retirement can not be determined,it is often difficult to protect the rights of the over-age workers because of the long time.In order to protect the over-age workers better,balance the relationship between Labor and management,and ease the tension of employment relationship,this paper aims at sorting out the difficulties and the problems in the relief of over-age workers.
