Qualitative Research On Highway Toll Evasion Behavior

In recent years,highway toll evasion has occurred frequently,especially the behavior of evading highway tolls by following a car,and the identification of such behaviors in judicial practice has always been controversial.The article starts with the typical cases of escaping expressway tolls by following a car many times,and conducts an in-depth analysis of the criminal nature of the behavior of following a car and escaping from the pole.On the basis of introducing typical cases,the article summarizes the controversial focus,and conducts an in-depth analysis and discussion around the controversial focus;first,it expounds the necessity of criminal law evaluation of the behavior of highway following and escaping from poles,and determines that this behavior should be regulated by criminal law.;Secondly,it analyzes property rights and property interests,and proves that property interests should belong to the object of property crime;in addition,it analyzes and discusses from the aspects of punishment consciousness,punishment behavior and whether the machine has the punishment consciousness,and thinks that the machine has the punishment consciousness;It is more reasonable to conclude that the behavior of following cars and escaping poles on the highway should be convicted and punished as the crime of fraud.
