Procuratorial organs' civil litigation right is a kind of civil litigation right exercised by procuratorial organs on behalf of the state in the civil field,aiming at safeguarding national interests,social public interests,people's legitimate rights and interests and judicial justice and authority.As a socialist procuratorial system with Chinese characteristics,the civil litigation right of procuratorial organs plays a very important role in civil litigation activities.However,in the process of comprehensively promoting the modernization of the national governance system and governance capacity in China,the complexity of conflicts of interest is far beyond legislators' expectation,and the current civil litigation right of procuratorial organs can not fully meet the needs of the public in social life,nor can it achieve the goal of protecting public interests and safeguarding judicial authority.At present,when the times and practice constantly put forward new requirements for procuratorial organs,there are still many shortcomings and deficiencies in the civil litigation right of procuratorial organs.In order to consolidate the legal supervision status of procuratorial organs,promote the full play of procuratorial functions and promote the quality development of procuratorial work,it is urgent to improve the research on civil litigation rights of procuratorial organs.Based on the basic theory,justification and comparison with foreign procuratorial organs,this paper sorts out the present situation and deficiency of procuratorial organs' civil litigation right,and then puts forward some suggestions on perfecting the system of procuratorial organs' civil litigation right in China.
