Research On The Criminal Liability Of Self-driving Car Accidents

As a large-scale artificial intelligence product,self-driving cars bring convenience to human’s travel and life,and the programmed automatic driving can avoid the situation of traffic accident caused by driver’s negligence when manual driving to some extent.But at the same time,due to the development of the self-driving vehicle is not long,the legal regulation of the self-driving vehicle accident is still blank,when the self-driving vehicle accident occurs,it is difficult to determine the corresponding criminal responsibility subject.Therefore,it is of great significance both in theory and in reality to strengthen the research on the relevant legal issues in the field of selfdriving vehicles.In order to discuss the problem of the criminal responsibility of the self-driving vehicle,this paper first analyzes the reasons why it is difficult to identify the criminal responsibility of the self-driving vehicle,that is,the self-driving vehicle contains various subjects,and the cause-effect relationship of the accident is complicated,the subjective state of mind,especially the fault responsibility,is difficult to find out.Secondly,this paper makes a detailed analysis of the reasons why it is difficult to identify the criminal liability of the self-driving vehicle.As the criminal liability of traffic accident caused by self-driving in this paper belongs to the crime of negligence,therefore,this part mainly aims at the attention duty of each behavior main body when the self-driving vehicle causes an accident to carry on the research in order to clear its should undertake the main body responsibility.At last,this paper analyzes the causeand-effect relationship with the objective imputation theory,and focuses on the criminal law cause-and-effect relationship between the behavior and the damage result under the complex situation of the escaping behavior.Although China’s self-driving car industry started late,but has been in the process of high-speed development.At present,it has already passed through the low level of auxiliary automatic driving.It has not yet reached the high level of full automatic driving,but it has already reached the level of conditional automatic driving,therefore,this paper mainly focuses on the analysis of the subject of criminal responsibility of the self-driving vehicle under the human-computer interaction mode in the 3-level conditional self-driving stage,which is widely used in the self-driving vehicle industry at present,in order to solve the judicial practice in the automatic driving accident responsibility cognizance provides the solution mentality.
