High-altitude Parabolic Crime Research

With the continuous improvement of our living standard,there is a kind of case with increasing frequency,which is the case of throwing objects from high altitude.As for the behavior of throwing objects from high altitude,it is being constantly improved in our country's legal system.From the perspective of regulating crimes,such illegal behaviors can be better regulated by the criminalization of throwing from high altitude.In the final draft of The Amendment to Criminal Law(Xi)of China,the throwing from high altitude is stipulated in Chapter 6 of the special provisions.As a new charge,crime and non-crime,the distinction between this crime and other crimes has become a crucial issue,it is necessary to distinguish “high altitude”,“throwing”,“serious circumstances” and other incriminating elements.At the same time,it can also be more conducive to distinguish between imaginary competition and cooperation with other charges.For the safety of people's life and property,the behavior of throwing from high altitude has a great impact on the stability and harmony of people's living community.Since the act of throwing from a high altitude has been defined as a criminal act by the Amendment of Criminal Law(11),it exerts a deterrent effect on people's psychology and can also regulate people's behavior to a certain extent.High altitude parabolic“punishment” is very be necessary,can better cope with the increasingly frequent,severe social harm gradually from high phenomenon,is the inherent requirement of perfecting the corresponding laws and regulations system,at the same time balance principle of legality and adapted for the principle,so as to better meet the objective requirement of social development.This paper will analyze the understanding and application of high altitude projectile crime based on the judgment of all parts of the country since its implementation,and discuss the related problems of high altitude projectile crime.In order to better solve this kind of problem,it is necessary to constantly improve the relevant judicial interpretation and case guidance,of course,the most important thing is to clarify the specific protection of the legal interests of the airborne throwing crime,so as to better achieve the legislative purpose.
