Currently,information technology is promoting the realization of electronic and digitalization of human society.In the judicial field,traditional forms of evidence are increasingly being replaced by the new type of electronic evidence.Compared with traditional evidence,electronic evidence,as a type of independent evidence based on information technology,has inherent deficiencies such as easier to be tampered with,easier to be copied,and more likely to be lost,making it more difficult to securely preserve.On the other hand,the existing statutory electronic evidence preservation procedures are cumbersome and passive,and the technical methods used by common third-party electronic evidence preservation are generally questioned,which cannot well meet the needs of all parties for electronic evidence preservation.This requires the development of a more efficient,convenient,safe and reliable new electronic evidence preservation model based on the existing electronic evidence preservation model,which can not only ensure the evidence effectiveness of the electronic evidence,but also satisfy the parties' efficiency requirements about the electronic evidence preservation.At the same time,blockchain technology has the characteristics of decentralization,tamper-proof,traceability,and trustworthiness,which determines that blockchain technology has a wide range and unique application value in the judicial field.As a result,the new evidence preservation model of blockchain electronic evidence preservation came into being.The trust mechanism,resistance to tampering and traceability of blockchain technology are naturally compatible with electronic evidence preservation,and are widely favored by parties in judicial practice.However,since the legal entities for electronic evidence preservation are People's Court and notary office,and blockchain electronic evidence preservation is a new thing in the digital age,although it has been extremely widely used in practice,the relevant laws,regulations,and industry norms are few.With the large-scale promotion and use of blockchain electronic evidence preservation,it is necessary to respond to the legal system,technical specifications,and regulatory procedures in order to enhance the evidence effectiveness of blockchain evidence and better meet the needs of litigation.Bringing new changes to the development of electronic evidence.In this context,this article will take the definition of the related concepts of blockchain electronic evidence preservation as the logical starting point,by combining the blockchain electronic evidence preservation model with the existing legal electronic evidence preservation model and the common third-party electronic evidence preservation model.By comparison,it is concluded that the huge advantages of the combination of blockchain technology and electronic evidence protection are obtained.On this basis,the necessity and feasibility of the establishment of the blockchain electronic evidence protection system in China are further discussed.The case study and analysis found the problems existing in the current practical application of blockchain electronic evidence preservation,and conducted an in-depth analysis of the causes of these problems,and pointed out the direction for seeking a perfect approach,and then separately from the legal level,the regulatory level,and the practice.The corresponding system construction ideas are put forward at the level,and multiple plans are implemented in order to solve the problems faced by blockchain electronic evidence preservation,and provide long-term development space for blockchain electronic evidence preservation,a judicial innovation model in the Internet environment,and ease the pressure of judicial.Pressure to allow advanced technology to serve our country's rule of law.
