First of all,equating a game with the overall picture of the game,its local elements,or computer software leads to a one-sidedness in defining a game.Games should be defined by the concept of theoretical plane works of art under copyright law.The player's manipulation of the game is a use of the functionality of the game as a practical work of art.The different categories of use based on the creative context of games can fall into the categories of creative use and non-creative use.The meaning of copyright law for game player's operation behavior needs to be clarified according to different game categories.Second,we introduce the value of free will to generalize the real world and define the game world by analyzing the difference between virtual and real.It is reasonable to introduce the concept of free will from the perspective of value unity among departments,copyright theory and jurisprudence principle.From this we can divide games into two broad categories:(1)free will games and(2)free will games.There are no free will games.These two categories can be further divided into strong deterministic games,weak deterministic games,relative free will games and absolute free will games(theory).Finally,the images created by gamers operating free-will games may,in principle,constitute creative acts,and should be protected through audio-visual works if they reach the height of originality.However,when the expressive space of such games approaches zero,the confusion of thought and expression will occur.In this case,the game player is actually "passively expressing" the developer's thoughts,and the operation behavior can be regarded as a "performance" behavior under certain conditions,and such images can be protected through the performer's right.When a player plays a non-free-willed game,there is no room for creation,so it makes no sense to discuss creative behavior.In different cases,the actions of game players may be classified as:propaganda(which may be protected by the performer's right),infringement and copying,and Nonuse.
