With the development of Internet economy,the integration of Internet and modern industry,especially with service industry,has resulted in a new business model,and then a new employment mode of "Internet platform+individual" has emerged.The individual of "Internet platform+individual" is expressed as a platform worker in this article.The platform worker mentioned in this article only refers to a class of people who register on the platform and provide labor services to users of the platform,excluding the workers who sign formal labor contracts with the platform and manage it internally.These new business models mainly include platform sharing,platform selfoperation,etc.,which are based on the Internet platform.Due to the new characteristics of Internet platform employment and more modern technical support,there are many differences between Internet platform employment and traditional employment.There are some maladaptive problems in the traditional labor relations identification system in the identification of employment relations on the Internet platform,which increases the difficulty and complexity of identification.There are more and more labor disputes between the Internet and the platform workers,and the point of dispute is whether the Internet platform has established labor relations with the platform workers.It is precisely because the traditional labor relations identification standard can’t adapt to the new characteristics of Internet platform employment,and the relationship between platform and platform workers can’t be accurately judged in practice.In addition,at present,there are few laws and regulations on labor relations identification in China,and the legal rank is low.In practice,it is common that the same case is judged differently,and the rights and interests of platform workers can’t be protected.This paper introduces several controversial cases of Internet employment mode in practice,analyzes the new features of Internet employment mode at present,and the difficulties in identifying labor relations of Internet employment mode.Based on the experience of foreign countries in the identification of labor relations on the Internet platform,this paper puts forward some suggestions on the identification system of labor relations on the Internet platform in China.It is necessary to clarify the main scope of employment relations on the Internet platform,and in a short period of time,improve the traditional labor relations identification standard according to the characteristics of new employment,and refine it.In the face of the long-term development of Internet platform employment,we can consider establishing the ternary structure of labor relations identification,and make special norms for the identification of Internet platform employment labor relations. |
