| Climate change has become a major problem of our times,seriously threatening human survival and sustainable development.To cope with global climate change,all countries have worked together to adopt the much-anticipated Paris Climate Agreement.However,the subsequent withdrawal of the United States from the treaty has brought the governance process to a deadlock again,triggering heated discussions and research on global climate governance at home and abroad.Practice has proved that seeking international legal cooperation in the field of climate governance is a scientific and effective means of regulation,but the current climate governance system is still incomplete,and relevant international legal cooperation is difficult to carry out due to numerous obstacles.Nowadays,the international situation is complex and changeable,and the climate issue needs to be solved urgently.It is necessary to further strengthen global climate governance,optimize the international legal system for global climate governance,actively carry out international cooperation in emission reduction,jointly deal with the climate crisis and build a beautiful home for mankind.Focusing on the central topic of the difficulties and Countermeasures of international legal cooperation in global climate governance,the paper first expounds the necessity and important nodes of international legal cooperation in global climate governance,and selects three landmark international treaties adopted in the process of governance,introduces their background,treaty characteristics and implementation and lay the foundation for the dilemma analysis in the following paper.Secondly,based on the development process of governance,with institutional design and practice as the standard of distinction,the dilemma faced by international legal cooperation in global climate governance is deeply analyzed.At the institutional level,it demonstrates the imperfection of its governance system from the lack of compulsory binding force of the treaty,low threshold and cost of withdrawal,and fragmentation of various governance mechanisms.At the practical level,we start from the non-negligible contradictions that hinder climate governance,mainly including the complex challenges of the climate issue itself,the interest game among sovereign states and the dilemma of collective action.Thirdly,corresponding optimization measures are put forward on both institutional and practical levels,including improving the compliance guarantee and withdrawal mechanism,integrating the governance mechanism,giving full play to the joint role of multiple governance entities,advocating the value concept of a community with a shared future for mankind,and innovation technology to provide technical support.Finally,based on the new requirements of current climate governance for China,it is proposed that China should continue to be an active practitioner of the Paris Agreement,actively participate in global climate governance actions at the international level and unite the majority of developing countries.At the domestic level,we should learn from the experience of other countries in climate legislation,accelerate the improvement of domestic climate legislation,strive to contribute Chinese strength to global climate governance,provide Chinese wisdom,assume Chinese responsibilities,and seize the opportunity to lead the construction of global ecological civilization. |
