Research On The Compensation Of Wildlife Damage In China’s National Parks

Since the construction of national parks in China,the habitat environment of wildlife has been continuously improved,the area has been continuously expanded,and the number of wildlife populations has resumed growth.Especially in national parks and surrounding areas,the range of activities of wild animals and human production and living space have overlapped a lot,so the occurrence of harmful events of wild animals has occurred.The construction of national parks has achieved effective protection of wildlife habitats and biodiversity,but the personal and property safety of citizens has been threatened or damaged.The law stipulates that citizens have the obligation to protect wildlife and the ecological environment,but also should stipulates that citizens have the right to defend their personal and property safety from infringement.However,wildlife poses a serious threat to the safety of citizens ’ lives and property,which directly affects people’s enthusiasm for participating in wildlife conservation and their support and recognition of national park construction.To this end,China has stipulated the relevant content of compensation for wildlife damage in the revised " Wildlife Protection Law " and encouraged local governments to carry out wildlife damage compensation insurance business.At the same time,legislation on national parks is also underway,and some local governments have formulated legal documents to improve the compensation for wildlife damage in national parks.However,the relevant laws still need to be refined.Therefore,by combining the current reality in China,this paper will put forward suggestions for improving the ecological compensation law for wildlife damage caused by national parks in China.This article will be divided into the following four parts: Chapter 1: An overview of ecological compensation for wildlife damage,defining the concepts of ’wildlife damage ’ and ’ ecological compensation for wildlife damage ’,and summarizing the theoretical basis,legal nature and institutional connotation of ecological compensation for wildlife damage from the perspective of law.Chapter 2:Collect and sort out the news reports of wildlife damage incidents in China ’s national parks,investigate and evaluate the legal status of ecological compensation for wildlife damage in China ’s national parks.Chapter 3: Investigate the practice of ecological compensation for wildlife damage in national parks outside the United States,Canada,and the United Kingdom,and learn from and gain inspiration.Chapter 4: Suggestions are put forward from three aspects: national legislation,local legislation and related supporting mechanisms,to improve the ecological compensation law for wildlife damage in national parks in China.It is expected that this will provide legal protection for citizens who participate in the protection of wild animals and obtain compensation for those who have transferred their rights and interests in the construction of national parks,so as to better help the construction of national parks and the protection of wildlife,promote the harmonious coexistence of people and wildlife,and establish a community of shared future for mankind in harmony with nature.
