A Study On The Zoning Control System Of National Parks

As an important part of China’s natural protected areas,national parks cover a wide area,and the natural ecological environment in the parks is characterized by diversity and complexity,which requires differentiated management.The zoning management and control system of national parks refers to the implementation of differentiated management means and supporting measures according to the characteristics of different areas of national parks on the basis of scientific and reasonable division of national park areas,so as to establish a complete system,which is the basic system to guarantee the construction and development of China’s national park system.Although the zoning control system of national parks has been established in China,there are still many problems in practice.One is the lack of legislation on zoning control of national parks.This is mainly manifested by the lack of legislation at the national level,and the differences in the regulations on zoning control in local legislation,resulting in the unclear right of zoning approval of the national park management agency.Second,the zoning model and zoning standard of national parks are not unified.Due to the complexity and diversity of the natural ecological environment of national parks,the value positioning of national parks in zoning management and control is unclear,which leads to the difficulty in unifying the zoning mode and zoning standard of various local national parks.Third,the responsibility provisions of zoning management and control of national parks are unclear.The responsibility centers of different zoning are not clearly defined in each local national park,and the legal responsibilities of relevant subjects within the region are also unclear.Fourth,the regulations of recreation service management are not comprehensive and the relationship between protection and utilization in national parks is not well balanced.Fifth,the lack of provisions on the rights and interests of the original residents leads to conflicts due to interest disputes in the process of zoning control of national parks.In order to effectively solve the problems in the zoning management and control of national parks in China,it is necessary to put forward improvement measures from three aspects: legislation,zoning standard and zoning mode,and specific norms of zoning management and control.The details are as follows: First,the legal system of national park zoning control system should be improved.In the law of Protected Natural Areas and The Law of National Parks,which are in the process of legislation,the standards,principles and modes of zoning control of national parks are determined in the form of laws.The approval procedures for national park zoning and the powers of national park management agencies should be clarified in local legislation.The second is to establish the zoning model and zoning standards of national parks.Clarify the value orientation of zoning management and control of national parks,and formulate unified zoning standards for national parks of the same type.Finally,it is necessary to establish a strict and complete responsibility system by region and subject,improve the recreation service management system of the national park,and improve the protection mechanism of the rights and interests of the original residents in the park,so as to optimize the relevant norms of the zoning control of the national park.
