Research On The Legal System Of National Parks In China

Since entering the modern society,our country has seen the ills of the ecosystem that the relationship between human and nature has become increasingly tense,one of the more prominent problems is that it is difficult to accurately control the balance between the protection and use of natural resources.In order to solve this type of problem,my country has delineated nature reserves,scenic spots and other natural protection areas,and has recently made greater efforts to promote the construction of national parks.In response to the system,various legal systems for national parks are also being gradually improved..The legal system of national parks is still a new thing in our country,combined with the current actual operation of the system,there are problems in the legal level of unclear definitions,lack of special laws,and conflicts among multiple related laws and regulations;Ambiguous ownership of national parks exists in related systems;The three aspects of planning,approval,and supervision of the national park planning system also have their own shortcomings;In the home park construction system,there are relatively chaotic situations such as unclear creation standards and unclear functional zoning;In the national park management system,there are problems such as excessive intervention by local administrative forces due to the non-independence of the powers and responsibilities of specialized agencies.These shortcomings make my country’s national park legal system have not really exerted its expected effectiveness.Therefore,it should be based on the status quo of the construction of the national park legal system in our country,combined with the inspection of the construction experience of developed countries with relatively complete development of the national park legal system in the United States and Canada,and promote the integration of the national park legal system at the legal level;Clarify the ownership of national parks;Improve the national park planning system,and formulate unified evaluation standards and clarify internal functional zoning to optimize the construction system of national parks;Constructing a vertical management model to improve the management system of national parks,hopes to provide a useful reference for the construction of the legal system of national parks in our country.
