Research On Environmental Protection Law In Overseas Investment Of Chinese Enterprises

With the increase of China’s capital export,environmental protection problems of Chinese enterprises investing abroad have become increasingly prominent,which not only brings a series of legal risks to business operations,but also has negative impact on China’s overall overseas investment and even the country’s international image.These problems and risks reflect the lack of environmental management ability of overseas investment enterprises in our country,defects in environmental regulation of host country,insufficient regulation of environmental behavior of overseas investment enterprises and insufficient attention to environmental protection content of international investment agreements,etc.This paper analyzes the connotation and types of legal risks of Chinese enterprises’ overseas investment environment from the perspective of environmental protection.From the perspective of host country,home country and enterprise main body,the causes of problems and risks are deeply analyzed,and then the countermeasures and suggestions are put forward to solve the legal problems of Chinese enterprises’ overseas investment environment.The research of this paper is divided into the following parts: the first part is the environmental protection issues in the overseas investment of Chinese enterprises.This part points out that in the process of the rapid development of China’s overseas investment,the environmental protection problems of Chinese enterprises become increasingly prominent.On the one hand,this is due to the strong environmental sensitivity of the industries and geographical distribution of Chinese enterprises’ overseas investment,which also objectively reflects the lack of environmental management ability of Chinese enterprises.Environmental protection problems make Chinese enterprises overseas investment face serious environmental legal risks.Combining with cases,this paper analyzes the connotation and types of environmental legal risks of Chinese enterprises overseas investment.The second part analyzes the current situation and shortcomings of environmental regulation in the host country.The third part analyzes the current situation of China’s regulations on the environmental behavior of enterprises’ overseas investment to find out the shortcomings and defects.The fourth part analyzes the content of environmental protection in investment agreements,including both international investment agreements and bilateral and multilateral investment agreements signed by China.The last part puts forward the countermeasures and suggestions to solve the problems of Chinese enterprises’ overseas investment environment.This paper adopts the research methods of combining theory with practice,literature research,induction and deduction.By sorting out and analyzing the problems and environmental legal risks faced by Chinese enterprises in overseas investment,this paper analyzes the underlying reasons,and then puts forward targeted countermeasures and suggestions.
