Due to the continuous disputes between China and the international community over cultural heritage,scholars are in urgent need of updated and professionally translated materials for guidance.Considering sundry property rights concepts related to intangible cultural heritage and studying cases on heritage conflicts and cross-border disputes,Intellectual Property,Cultural Property and Intangible Cultural Heritage,translated into Chinese in162,321 words,will be required reading for students,scholars,and cultural-oriented lawyers engaged in heritage studies.The translation practice is based on Nord’s function-plus-loyalty theory,according to which the principles of legal text translation can be further divided into the principles of accuracy,conciseness and professionalism.Nord’s function theory requires translators to consider the realization of the function of the translated text and to accurately convey the information of the translated text,which requires the translation to abide by the principle of accuracy;while his loyalty theory requires that the original text should not be changed arbitrarily for the sake of the function,that is,the translation should be loyal to the original text,the author and the environment of the translated text at the same time,which requires the translation to abide by the principles of conciseness and professionalism.The report first analyzes the linguistic features of the translation project at three levels.The legal text boasts polysemy,overlapping synonyms and abbreviations at the lexical level,features many nominalizations,passive voices and long and difficult sentences at the syntactic level,and characterizes strong logic and close linkage between chapters at the textual level.On this basis,at the lexical level,the translator first adopts annotation and literal translation to deal with the translation of the polysemous;uses omission and word-for-word translation to tackle with overlapping synonyms;as for abbreviations,chooses literal and zero translation with a view to achieving the principle of accuracy and professionalism.At the syntactic level,conversion and inversion are used to translate nominalizations;passive voice conversion and substitution are to translate passive voices;and combination and repetition are to deal with long and difficult sentences,in a bid to meet the requirements of conciseness and accuracy principles respectively.Lastly,at the textual level,amplification and reference are applied to ensure the logical connection,and division as well as combination to fully present the coherence of chapters,so as to meet the requirements of accuracy,conciseness and professionalism.The purpose of this report is to disseminate knowledge of the relevant laws and to respond positively to the call of the state by translating this text.It is also hoped that the translation strategies applied in this report will serve as a reference and inspiration for translators who translate such texts. |
