For a long time,all countries in the world to maintain women’s rights,to improve the social status of women,the fight for gender equality as one of the important indexes of measuring national progress,in 2001 the world bank even as one of the goals of the development of gender equality,because their thought to promote gender equality is to promote economic development,social governance and an important measure to reduce poverty.Several important international meetings in the past few decades in the policy,and to improve women’s social status,the promotion of gender equality,pay close attention to and seriously,such as the world development report 2012,direct to "gender equality and development" as the theme,emphasis on promoting gender equality will help improve productivity,improve the development of the next generation of the results.In addition,up to now,183 countries have signed the convention on the elimination of all forms of discrimination against women,which shows that countries all over the world attach great importance to women’s human rights and have an urgent expectation for gender equality.Divorce relief system in our country also has been developing in women’s rights protection,"marriage law",from 1950 to 1980 "marriage law",the "marriage law"amendment to the 2001,divorce relief system in our country is increasingly perfect,formed in divorce fault compensation system,system of economic compensation system of divorce and divorce economic help three system as the main body of the divorce relief system.National conditions of our country are also changing,according to the latest statistics released by the Chinese ministry of civil affairs website,annual average 2018 per 100 people get married,there are 38 people divorce,is our country’s high divorce rate,and other series of data show that women in divorce in a relatively weak position,the divorced women rights and interests is difficult to secure when divorce,Concubinage as husband and others cannot prove,beyond the legal situation of serious marriage do v.slam shut,new obtain employment gender discrimination,and make housework cannot measure,after divorce,to apply for a spouse to provide economic security of the housing be help them harder,lack of maintenance of payment guarantee,etc.,make divorced women life harder.System construction is the key to pay attention to vulnerable groups and protect women’s rights and interests.Designing a reasonable and effective system can better promote social fairness and justice.The divorce relief system is an important part of the divorce system,which is of positive significance for the practical maintenance of social order,the protection of women’s rights and interests,and the maintenance of social stability and development.China’s current divorce relief system has achieved some results over the years,but there are also some problems.There have been some opinions on the problems and improvement of the divorce relief system in the academic circle.The author aims to see some problems that may exist in the divorce of divorced women in real life from the perspective of women’s rights and interests,and refer to foreign legislation examples to further improve the protection of women’s rights and interests in China’s divorce relief system.
